French ‘iPod bill’ seeks digital music player interoperability

Legislation pending in the French Parliament would require that music purchased online for use on digital music players be compatible across all players. It has become popularly known in France as the “iPod bill,” after the popular music player made by Apple Computer, and could pit France against Apple and other distributors of online music.
The National Assembly (lower house) and Senate (upper house) have passed two separate versions of the legislation. Both would reduce the penalties for piracy, require software companies to provide details on how their programs work, and create an agency that would have jurisdiction over digital copyright issues, including how often music can be legally copied by a customer for personal use and ensuring compatibility across devices.
Unlike the Assembly version, the Senate version does not contain provisions that would require manufacturers such as Apple and Sony to open all music sold on their platforms to work on players other than their own. Currently, the stores for Apple and Sony sell music only for use on their own players. Critics of the changes say that the Senate’s changes would defeat the purpose of the bill.
The two versions must now be reconciled in conference committee, a process that could take months.
Speaking in support of the bill, Assembly member Christian Paul said, “We oppose the idea that the seller of a song or any kind of work can impose on the consumer the way to read it, forever, and especially in the consumer’s home. Can we allow a couple of vendors to establish monopolies tightly controlling their clients and excluding competition?”
Christian Vanneste, the National Assembly sponsor of the iPod bill, said, “In France, there are two distinct mentalities. On one side is the backwards left, which is anti-American, and on the other is the right, which thinks that the U.S.A. shouldn’t be the only one with good ideas, and who want to compete with them.”
After the National Assembly’s vote in March, Apple denounced the measure as “state-sponsored piracy.” They refused to comment on the legislation after the Senate’s vote on May 10.
Francisco Mingorance, European policy director for the Business Software Alliance, said that the Assembly’s proposal is “about ripping off technology from those who developed it and putting it in the public domain.” The Business Software Alliance represents Apple, Dell, Microsoft Corp., Hewlett-Packard Co. and other major computer hardware and software companies.

New York –”Buy cheap Viagra through us – no prescription required!” Anyone with an active email account will recognize lines like this one. According to some reports, unsolicited advertisements (spam) for Viagra and similar drugs account for one in four spam messages.
BACKGROUND
Spamming remains one of the biggest problems facing email users today. While users and systems administrators have improved their defenses against unsolicited email, many spammers now insert random words or characters into their letters in order to bypass filters. Ever since pharmaceutical giant Pfizer promised to cure erectile dysfunction once and for all with its blue pills containing the drug sildenafil citrate, spammers have tried to tap into male anxiety by offering prescription-free sales of unapproved “generic” Viagra and clones such as Cialis soft tabs. Legislation like the U.S. CAN-SPAM act has done little to stem the tide of email advertising the products.
Now Pfizer has entered a pledge with Microsoft Corporation, the world’s largest software company, to address the problem. The joint effort will focus on lawsuits against spammers as well as the companies they advertise. “Pfizer is joining with Microsoft on these actions as part of our shared pledge to reduce the sale of these products and to fight the senders of unsolicited e-mail that overwhelms people’s inboxes,” said Jeff Kindler, executive vice president at Pfizer.
Microsoft has filed civil actions against spammers advertising the websites CanadianPharmacy and E-Pharmacy Direct. Pfizer has filed lawsuits against the two companies, and has taken actions against websites which use the word “Viagra” in their domain names. Sales of controlled drugs from Canadian pharmacies to the United States are illegal, but most drugs sold in Canada have nevertheless undergone testing by the U.S. Food and Drug Administration. This is not the case for many of the Viagra clones sold by Internet companies and manufactured in countries like China and India. While it was not clear that CanadianPharmacy was actually shipping drugs from Canada, Pfizer’s general counsel, Beth Levine, claimed that the company filled orders using a call center in Montreal, reported the Toronto Star.
For Microsoft’s part, they allege that the joint effort with Pfizer is part of their “multi-pronged attack on the barrage of spam.” As the creator of the popular email program Outlook, Microsoft has been criticized in the past for the product’s spam filtering process. Recently, Microsoft added anti-spam measures to its popular Exchange server. Exchange 2003 now includes support for accessing so-called real-time block lists, or RTBLs. An RTBL is a list of the IP addresses maintained by a third party; the addresses on the list are those of mailservers thought to have sent spam recently. Exchange 2003 can query the list for each message it receives.
Rescued Australian miners sign multi-million dollar media deal

The two Australian mine-workers, who were trapped for 14 days underground in a collapsed mine, have signed a media deal reportedly worth AUD$2 million for their story of survival. Local media reports that the lucrative deal, announced by the Nine Network, is believed to be the “highest ever paid to secure news talent”. A planned TV special will be the outcome of a deal secured by Publishing and Broadcasting Limited (PBL), which owns the Nine Network.
Miners Todd Russell and Brant Webb were entombed nearly a kilometre underground following a cave-in on April 25 at the Beaconsfield Gold Mine in Tasmania. A third miner, Larry Knight, was killed in the rock-fall. The two survivors trapped in a wire cage, survived by drinking water seeping through rocks until rescuers managed to dig a small tunnel to deliver fresh food and water. Their tale has captured the attention of the nation, with media corporations fighting for exclusive rights to the miners’ story.
The Nine Network’s chief executive Eddie McGuire said under the PBL deal, Woman’s Day, the Australian Women’s Weekly and the Bulletin magazines would also have access to the men. The Nine Network has announced it would broadcast a two-hour special with entitled “The Great Escape.”
Another deal is expected to be brokered with U.S. media. Mr McGuire said the deal would not restrict the pair from selling their story to CNN, the US Today Show and Good Morning America, who have all reportedly made contact with Mr Russell and Mr Webb this week.
Under the PBL deal, Woman’s Day, the Australian Women’s Weekly and the Bulletin magazines would also have access to the men, Mr McGuire said. Nine says it also wants the footage and photographs taken by the miners during their ordeal. The footage remains in the hands of the mining company.
The men, who were rescued on May 9, have not spoken publicly about the time they spent trapped underground.
U.S. Supreme Court upholds health care mandate

In a decision today, the U.S. Supreme Court has upheld the controversial healthcare law, the Patient Protection and Affordable Care Act, passed in 2010. The Supreme Court also upheld the individual mandate provision of the law, which would require most U.S. citizens to obtain health insurance by 2014, or pay a monetary penalty.
The Supreme Court ruled on the law 5–4. Chief Justice John Roberts authored the majority opinion. Justices Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor jointed Roberts in the majority, while Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas were in the minority in supporting the repeal of the law.
The Court did, however, strike down a provision of the law which would have expanded Medicaid to make coverage available to anyone with an income less than 138% of the federal poverty line.
President Barack Obama made a public statement from the White House saying that the Supreme Court’s upholding of the law, “reaffirmed a fundamental principle that here in America — in the wealthiest nation on Earth – no illness or accident should lead to any family’s financial ruin.” Obama further added, “Whatever the politics, today’s decision was a victory for people all over this country whose lives will be more secure because of this law and the Supreme Court’s decision to uphold it.” Obama closed his statement by saying, “The highest Court in the land has now spoken. We will continue to implement this law. And we’ll work together to improve on it where we can. But what we won’t do — what the country can’t afford to do — is refight the political battles of two years ago, or go back to the way things were.” Adding, “With today’s announcement, it’s time for us to move forward — to implement and, where necessary, improve on this law.”
Republican presidential candidate Mitt Romney also gave a statement from Washington, D.C. saying, “What the Court did not do on its last day in session, I will do on my first day if elected President of the United States. And that is I will act to repeal Obamacare.” Romney clarified further by saying, “Let’s make clear that we understand what the Court did and did not do. What the Court did today was say that Obamacare does not violate the Constitution. What they did not do was say that Obamacare is good law or that it’s good policy.” Further adding, “Obamacare was bad policy yesterday. It’s bad policy today. Obamacare was bad law yesterday. It’s bad law today.” Romney closed by saying, “Our mission is clear: If we want to get rid of Obamacare, we’re going to have to replace President Obama.”
Eric Cantor, Republican leader in the U.S. House of Representatives, announced shortly after the ruling that the House would vote on repealing the law on July 11, following the July 4 holiday recess. Cantor said, “The Supreme Court’s decision to uphold Obamacare is a crushing blow to patients throughout the country. Obamacare has failed to keep the President’s basic promise of allowing those who like their health care to keep it, while increasing costs and reducing access to quality care for patients.”
In the ruling of National Federation of Independent Business v. Sebelius, John Roberts wrote, “Simply put, Congress may tax and spend. The federal government may enact a tax on an activity that it cannot authorize, forbid or otherwise control.” Meanwhile, Justice Anthony Kennedy authored the dissenting opinion, saying the entire law should have been repealed.
The ruling on the law comes after 26 states challenged the law in oral arguments in front of the Supreme Court in March.

Nasal allergy is a quite common illness that everybody can have it. It is caused by the exposure of the individual to the various types of allergens such as pollen, fungus, mold, dust mites, certain foods, latex, animal dander, volatile chemicals and others. When allergens were inhaled into the nasal cavity, it penetrated mucosal membrane and came to contact with blood serum. Individual with Immunoglobulin-A antibody deficiency will easily let the allergens penetrate mucosal barrier because deficiency of Immunoglobulin-A antibody increases the mucosal permeability. Macrophages are the first type of cells that will come in contact with the allergen particles and after processing the allergens; it will pass information about the invasion of the allergen particles into the body to B-lymphocyte cells (one type of the white blood cell). This will stimulate B-lymphocyte cells and cause them start to multiply and transform into plasma cells. Stimulation of the B-lymphocyte is controlled by T-lymphocyte cell (the other type of white blood cell). The plasma cells that have been formed will produce IgE antibodies, which after that bind with the mast cells and basophil cells around nose and cause itching and hypersensitive. What we know that why an individual s nose easily becomes allergy is due to the deficiency of Immunoglobulin-A antibody, which is one of our defense components in our body. Its function is scavenging of exogenous material, which is coming in contact to the mucosal membrane. Apart from this, T-lymphocyte cells, which are developed in bone marrow, work as helper and suppressor to the secretion of immunoglobulin by the B-lymphocyte cells. Malfunction or deficiency of these cells will cause over secretion of immunoglobulin-E antibodies. This may exacerbate the nasal allergy illness. All this malfunction and deficiency may due to the genetic disorder inheriting from our parent. However, it may also cause by our irregular lifestyle, unhealthy eating habit and environmental factor such as not enough sleep, eat too much fried food, smoking, alcoholic, exposure to hazardous chemicals and so on. Infection with certain virus such as HIV or utilized certain steroid or chemotherapy medicines may also cause this problem. In other words, deterioration of the body immune system will make nasal allergy illness become more critical. Due to this, in order that one can relieve from the nasal allergy torturing, he or she must have a strong immune system to defend the foreign substances that will enter into their body.
Deterioration of immune system mostly due to the attack by the free radicals that have formed in our body. Free radical is a very reactive molecule and has a strong tendency to oxidize lipid, protein and DNA in our body. Everyday, a lot of free radicals are produced in our body. Although our body itself can generate antioxidant to protect ourselves, it is still not enough. That’s why, we are all aging. Free radicals that have been generated in our body can weaken our body immune system by attacking to the white blood cells. Changing the DNA in a white blood cell is the most crucial point because it causes irreversible mutation of the cell. Due to this, white blood cells can not function properly and become malfunctioned. When this happening, nasal allergy illness will emerge in our body. To protect our body from radical and maintain our body immune system, we need to take enough antioxidant supplements to neutralize the excessive free radicals that have been produced in our body everyday.
Vitamin C is the most common antioxidant that can relief nasal allergy symptom. But the doses that we need to take to stop the nasal allergy are around five to eight gram. This is quite a large amount and it may cause stomach and intestinal upset. To prevent this, we should use ascorbate form of vitamin C. Until now, there is no solid evidence to show how vitamin C can stop the nasal allergy reaction. But scientists figured out that it may due to its antioxidant capabilities, which prevent cell damage. Research had been carried out in the department of obsterics at Methodist Hospital in Brooklyn to study vitamin C and histamine levels in the blood of 400 people. They found out that, people with high levels of vitamin C in their blood have lower histamine levels. When 1000mg vitamin C supplement was given daily to those with low levels of vitamin C and high levels of histamine, their hay fever improved remarkably within three days. [Journal Nutrition, April, 1980]. When large amount of vitamin C is taken, just make sure you take calcium supplement. This is because; vitamin C in the blood will bind with the calcium in the bone and attract them out into the blood. This calcium will be discarded from the body through urination. This is because vitamin C is an organic acid that can dissolve mineral in bone. To avoid this, we should take calcium ascorbate, which is a mineral form of vitamin C.
Vitamin C is very soluble in water. Therefore, high levels of vitamin C in the blood may not be easily achieved. This is because vitamin C easily excretes from the body through urination. More frequent you urinating; less vitamin C can be retained in your body. Therefore, although we take a lot of vitamin C, the actual amount retaining in the body in very little. You may relief the nasal allergy for a while and if you want to continually remain relief from nasal allergy, you may need to continually take vitamin C. This situation can be seen after we have taken the vitamin C. The urine that we excrete after one hour taking the vitamin C is yellowish color. The color is due to the presence of the vitamin C in the urine. The following urine may still yellowish. After the urine no longer shows any yellowish color; that means the vitamin C levels in the blood has gone down already. Due to this, a lot of vitamin C has been wasted. To save cost, we need to take citrus bioflavonoids and pantothenic acid. Both of them are vitamin B complex substances. Citrus bioflavonoids alter the body s metabolism of vitamin C and raising the concentration of vitamin C in certain tissue [American Journal of Clinical Nutrition, August, 1979]. Whereas, pantothenic acid can help our body absorbs vitamin C more easily.
Apart from vitamin C and B, the second supplement that can boost our immune system is zinc. Zinc is a transitional metal that is indispensable in our body. Biochemical functions in our body that involves zinc are protein synthesis, spermatogenesis, platelet reactivity and the main one is maintaining cellular immunity. Apart from these, zinc also can prevent certain type of cancer. Zinc deficiency mostly due to malnutrition, alcoholism, malabsorption, liver cirrhosis, chronic renal disease, extensive burns, use of chelating agents and genetic disorders. Our meats that contains high amount of zinc are chicken and beef. People who try to avoid red meat due to its high cholesterol have the higher possibility not enough zinc in their body. Zinc deficiency can cause growth retardation, male testerone deficiency, delayed wound healing, bullous dermatitis, diarrhea and intercurrent infection. Zinc can inhibit replication of several viruses such as herpes simplex virus, foot and mouth disease virus, poliovirus and rhinovirus. Zinc is very effective to treat common cold because it prevents rhinovirus (cold virus) from binding to the tissue surface and stabilizes the cell membranes. Subsequently, it is also inhibiting prostaglandin metabolism and inducing production of interferon gamma, which is a natural chemical that help body to fight infections. Study that had been published in the Annals Internal Medicine in 1996 showed that if an individual starts taking zinc gluconate glycine within 24 hours onset of the common cold symptoms, it can significantly reduced the illness duration.
The third supplement that has antioxidant function is virgin coconut oil. The difference between ordinary coconut oil and virgin coconut oil is that the later is extracted by wet process directly from the coconut milk or meat under a control temperature usually is 50 oC, whereas; coconut oil is obtained from the copra by dry process, which involves high temperature or sunlight exposure for several days. Due to the exposure to sunlight and application of high temperature, most of the minor components such as tocopherols, tocotrienols and polyphenols will be destroyed. This is because all these components are unstable in high temperature. Sunlight can destroy there components because sunlight contains a few percent of UV light, which is a high energy wave that can break the chemical bonding in an organic substance. Recently, study had been carried out in University Kerala in India to determine the effectiveness of the virgin coconut oil as antioxidant enzymes in male rat [Food Chemistry, 2006]. They found out that virgin coconut oil has more effect as an antioxidant and prevents peroxidation of lipids compared to the groundnut oil and copra oil. Study also had been carried in the same University to determine the beneficial effect of the virgin coconut oil to lipid components in male rat [Clinical Biochemistry, 37, 2004]. The finding that they got is that virgin coconut oil can reduce the levels of lipid in serum and tissues. Besides, it also can reduce low-density lipoprotein (LDL) and increased high-density lipoprotein in the blood. This effect may due to its high polyphenol content.
Finally, what we know immunoglobulin-A (IgA) antibodies are the main antibodies that can prevent allergens from entering our body through nasal mucosal membrane. Therefore, nasal allergy and sinus infection can be prevented by increasing this antibody level in our body. Nutrients that can boost this antibody level in our body are monounsaturated oleic acids and vitamin A. Monounsaturated oleic acids can be found in cold-pressed extra virgin olive oil, hazelnut or filbert oil (or the whole nuts), green and ripe olives, and almonds. Death toll from Borneo bridge collapse reaches eleven

The death toll from the weekend suspension bridge collapse on the Indonesian island of Borneo has risen from four to eleven. Search and rescue teams continue to look for bodies in the Mahakam River.
The number of wounded is currently 39 injured; reports from locals suggest 33 people remain missing at the scene in East Kalimantan’s Kutai Kartanegara district, where “Kalimantan’s Golden Gate Bridge” linked the towns of Tenggarong and the regional capital, Samarinda. A six-month-old baby is among the dead.
Cars, motorbikes, and buses all fell into the Mahakam River when the bridge came down during repairs. Another car was left overturned and balanced upon wreckage over the water. State-owned builders PT Hutama Karya completed the bridge about a decade ago in the image of California’s Golden Gate Bridge. A cable on the 720-metre structure is thought to have failed as workers dealt with it; six of the repair crew were reported missing yesterday. It had been the longest suspension bridge in Borneo.
Eyewitnesses described heavy traffic at the time of the collapse, and one survivor said he left his truck to investigate a traffic jam. Some people were left trapped by debris as the bridge came down. “It happened so fast, only about 30 seconds,” according to National Disaster Management Agency spokesman Sutopo Nugoroho.
National search and rescue head Daryatmo said yesterday cranes will attempt to move debris today, with new reports saying echo-sounding equipment will be used to check it is safe to begin lifting. It is believed the bodies of more victims will be found trapped in vehicles beneath the water, which is 35-40 metres deep. Visibility is poor, and one official explained authorities are still unsure how many vehicles are on the riverbed.
“The above-water search is continuing, but underwater operations have not been carried out because we’re worried that the bridge’s pylons are unstable and could collapse any time,” said Nugoroho today. He explained that bodies had washed onto the riverbanks overnight and were recovered today.
The president, Susilo Bambang Yudhoyono, has sent three ministers to the site to investigate the accident, while Bambang Widaryatmo, head of East Kalimantan’s police, promised “parties found to be negligent will be prosecuted”. The government has promised a replacement ferry service. The river is closed to boats as rescue operations continue, and a 22-strong team has been dispatched from the national police, comprising six forensics experts, five disaster victim identification specialists, and eleven investigators. They are there to augment the East Kalimantan Police. Health Minister Endang Rahayu Sedyaningsih yesterday visited survivors in Parikesit Hospital and promised them medical treatment at government expense.
Some people swam ashore after falling, with the aftermath filled with screams. Survivor Syakrani, 24, yesterday asserted “The authorities should have closed the bridge if it was under repair.” His words were followed by a Jakarta Globe editorial declaring the accident “unacceptable”.
The Globe went on to comment upon suggestions corruption may have played a role; “It is too early to point fingers and look to place blame, but if shoddy materials were used in the building of the bridge, those responsible must answer to the public.” Another suggestion is coal barges striking the bridge may have weakened it. Local coal company Harum Energy lost five percent of its share value today amid fears the river blockage will hamper their ability to ship coal.
Samarinda’s seen a population and construction boom lately. A few years have seen the population triple and the construction of a large mosque, and a sports stadium; an airport and port are set to follow. However, the Corruption Eradication Commission warns 70% of the corruption it investigates concerns government contracts and up to 40% of money earmarked for infrastructure ends up stolen.
Man arrested in connection with Honolulu toddler death

Matthew Higa, 23, has been arrested in connection with the death of a 23-month-old boy. Higa is alleged to have thrown the child from a pedestrian overpass into oncoming traffic on Honolulu’s H-1 Freeway.
The local coroner’s office noted that the child died on impact after falling 30 feet (9 meters) from the overpass. This occurred during Thursday’s lunch rush hour in the heart of downtown. Upon impact, several cars struck the child, which caused traffic to grind to a halt.
The toddler, Cyrus Nainoa Tupa?i Belt, was pronounced dead at the scene at 12:07 p.m. (2207 UTC), approximately 27 minutes after being allegedly being ejected from the overpass by Higa. The portion of H-1 was closed for approximately five hours with traffic diverted to side streets. The freeway was reopened in time for the evening commute.
At first the relationship between Higa and the child was unclear, but later reports stated that Higa lived adjacent to him and had babysat him on previous occasions. The boy’s mother was out of town at the time of his death, but it was revealed that the child was supposed to be in the custody of his father and not with Higa.
Higa graduated from Roosevelt High School in 2003. In the summer of 2004 Higa was involved in an incident where police reports indicate a three-car race resulted in the death of a friend. Higa has since had a criminal history, with more than a dozen arrests but no convictions, and reports from neighbors of erratic behavior.
Queen’s Medical Center, which houses a psychiatric ward in Honolulu, noted that he was a patient there as recently as December 11, 2007. When arrested, Higa was wearing hospital scrubs, which were not immediately conducive to whether Higa was a patient in Queen’s psychiatric wing in the last couple of days. A representative of Queen’s declined to comment on whether Higa was admitted in the last week.

With a Queensland state election coming up in Australia, many minor parties will be looking to hold balance of power and making the major parties listen to what they have to say. The Socialist Alliance (SA) is one of these parties.
SA is a left-wing political party. There stated describes itself as an anti-capitalist party which believes in “a democratic society that is run by and for working people, not the tiny, greedy, destructive elite that now rules.”
It should be noted that SA is not registered for Queensland elections due to what they describe as “restrictive rules for registration.” Their candidates will run as independents. They are, however, registered for federal elections and elections in other states.
Queensland’s unicameral parliament is up for election on March 21. The election campaign will run for a total of 26 days following the issue of the writs by Governor Penelope Wensley.
